What is the legal definition of custody in Colombia? Child Custody in Colombia is regulated by the 1098/2006 Law (Law code for Infants and Adolescence) that in its 23 Article Defines Custody and Personal Care as a special care that belong specifically for law to the parents. It’s important to take note that parental authority and custody aren’t the same; this because child custody is the physical possession of the children, in other words is whom the children will live. Instead parental authority is the judicial and extrajudicial legal representation, usufruct and administration of children assets, that is all the duties and rights that parents have in relation to their children.
